In consideration of being permitted to participate in any activities, programs, leagues, tournaments, events, training sessions, or use of the fields, facilities, equipment, and premises of Futbol5, LLC (the "Club"), the undersigned participant (the "Participant") agrees to the following terms.

1. Assumption of Risk

Participant understands that participation in soccer and related activities ("Activities") carries inherent risks, including but not limited to:

• Falls, collisions with other players, goals, or field equipment

• Being struck by a ball

• Contact play, including tackles, physical challenges for the ball, and unintentional contact with other players

• Strains, sprains, fractures, dislocations, concussions, and other soft-tissue or orthopedic injuries

• Cardiovascular events arising from physical exertion

• Injuries caused by the action, inaction, or negligence of other participants, coaches, referees, or spectators

• Slip-and-fall or other hazards related to field or turf conditions, weather, or facility conditions

Participant voluntarily assumes full responsibility for any risk of loss, property damage, or personal injury, including death, that may be sustained as a result of participating in the Activities, whether or not caused by the negligence of the Club.

Participant specifically acknowledges that soccer carries a risk of concussion and other head injuries. If Participant is a minor, the parent or legal guardian acknowledges receipt of concussion and head-injury safety information consistent with Tennessee's youth athletics concussion law, and understands the Club's protocol for removing a Participant suspected of a concussion from play.

2. Release and Waiver of Liability

To the fullest extent permitted by law, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue Futbol5, LLC, its owners, operators, officers, employees, coaches, contractors, volunteers, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant while participating in the Activities or while on the Club's premises, whether caused by the negligence of the Released Parties or otherwise, except where prohibited by law.

3. Indemnification

Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that the Released Parties may incur due to Participant's presence at or participation in the Activities, whether caused by the negligence of Participant or otherwise.

4. Medical Treatment Authorization

Participant certifies that they are physically fit and have not been advised otherwise by a qualified medical professional, or is participating at their own risk in light of any condition. Participant authorizes the Club's staff to arrange for or administer emergency first aid or medical treatment, including transportation to a medical facility, if deemed necessary, and agrees that Participant (or their insurance) is responsible for any resulting medical costs.

5. Facility Rules and Code of Conduct

Participant agrees to follow all posted rules, staff instructions, and the Club's Code of Conduct while on the premises, and understands that failure to do so may result in removal from the Activities or suspension of their Club account.

6. Photo and Video Release

Participant grants Futbol5, LLC permission to capture and use photographs and video footage of Participant, including match and training footage, for security, coaching, and reasonable promotional or marketing purposes, without compensation. Participant may decline this section without affecting their ability to participate; contact the Club directly to opt out.

7. Participants Under 18 Years of Age

If the Participant is a minor, this Waiver must be read and accepted by a parent or legal guardian, who represents that they have the legal authority to do so on the minor's behalf and who personally agrees to all terms above, including the Release and Indemnification sections, on behalf of both the parent/guardian and the minor.

8. Governing Law and Severability

This Waiver shall be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Nothing in this Waiver releases the Released Parties from liability for gross negligence, recklessness, or willful or wanton misconduct, to the extent such a release is prohibited under Tennessee law. If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment and Acceptance

By clicking "Accept" or "Approve" on this Waiver, the Participant (or, if the Participant is a minor, their parent or legal guardian) confirms that they have read this Waiver in its entirety, understand its terms, understand that they are giving up substantial legal rights, including the right to sue, and agree to be bound by the Assumption of Risk, Release of Liability, Indemnification, and all other terms above, voluntarily and of their own free will. This electronic acceptance shall have the same legal force and effect as a handwritten signature.
